Nefa.Ai Terms And Conditions

 

These Terms and Conditions ("Terms") govern your use of our app, Nefa.Ai ("the App"), which allows users to track and reflect on their emotions through visual tools and voice-based emotion analysis. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1. Use of the App
   1.1 Eligibility:
   You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this requirement.
   1.2 License:
   Sunloft Studio grants you a non-exclusive, non-transferable, revocable license to use the App for personal, non commercial purposes in accordance with these Terms.
   1.3 Prohibited Conduct:
   You agree not to:
   - Use the App for any illegal or unauthorized purpose.
   - Interfere with or disrupt the App or servers or networks connected to the App.
   - Attempt to gain unauthorized access to any portion of the App, other users' accounts, or any systems ornetworks.​
    

2. Intellectual Property
   2.1 Ownership:
   All rights, title, and interest in and to the App, including all intellectual property rights, are and will remain the exclusive property of Sunloft Studio or its licensors.
   2.2 Restrictions:
   You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code of the App, unless laws prohibit these restrictions or you have our written permission.
    

3. Privacy and Microphone Access
   3.1 Data Collection:
   The App does not collect any personal information. For more details, please refer to our Privacy Policy.
   3.2 Voice Data and Microphone Access:
   The App includes an optional feature that allows users to record a 3-second voice sample to analyze emotional tone. This voice sample is processed locally on the device and is not stored, transmitted, or shared. It is permanently deleted after analysis.
   The emotion recognition model runs entirely in memory and does not store voice data on disk or use it for machine learning. Microphone access is requested only when the feature is used and can be denied or revoked at any time through device settings.
    

4. Disclaimers and Limitation of Liability
   4.1 No Warranty:
   The App is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. Nefa disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
   4.2 Limitation of Liability:
   To the fullest extent permitted by applicable law, Nefa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
   (i) your use of or inability to use the App;
   (ii) any unauthorized access to or use of our systems;
   (iii) any interruption or cessation of transmission to or from the App;
   (iv) any bugs, viruses, or the like that may be transmitted by any third party.
    

5. Modifications to the Terms
   Sunloft Studio reserves the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms within the App or on our website. Continued use of the App after such changes constitutes your acceptance of the new Terms.
    

6. Termination
   Sunloft Studio may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including a breach of these Terms. Upon termination, your right to use the App will immediately cease.
